Received the confirmation and scheduling order from The West Virginia Supreme Court. It seems the have concluded that my case against Mark Towle is worth further consideration. I will continue the fight in West Virginia as Well as the fight against his false claims against me in California.
It has also been brought to my attention I do not know if this is true or not, but I was told that he is making false claims against me in his case against DC Comics as well claiming the Web Site was my doing or that any trouble he might have with DC Comics due to the Web Site he had me create for him which I have never still received payment for was my fault. If this is true, that he is making these claims they are ludicrous. Mark Towle was well aware of all that was being done per his instructions because he and Kory Geick instructed me or had the opportunity over several years to revise the Web Site which I did when requested to. I also have a signed 2nd contract by Notary that Mark Towle approved the first web site as well as have him recorded... telling me it was "phenomenal".
To date my money remains stolen, my donor Corvette has not been released to me and is also stolen, my Butts Batmobile Replica Kit that Mark Towle admitted I owned in our second contract has still been denied me..."STOLEN". Now I have to hear about, whether true or not that he is "possibly slandering me" in his battle with DC Comics to try and escape their suit against him. What a Great GUY!
The fight continues. DC Comics as well as anyone would know and certainly a Judge and Jury would know that any web Site that was up and active for several years was by effect of time left active approved fully by the person that contracted for it, even if he ripped off his Web Designer "ME" and gave "ME" nothing for years of sacrifice money paid to him and work performed. If he is making these claims they simply won't fly. I know this and the Attorneys for DC Comics know this. They probably already have copies of his approval of the Web Site signed and notarized by himself "Mark Towle". I don't have to give DC Comics anything they can't get from the public records and recordings of my case. That's why I am being left alone at present, I think. Not Sure.
I have not done anything to hurt the other builders. I never did anything to hurt Mark Towle till he made it impossible for me to get paid or get the replica I paia hard earned money for and duely earned by completeing years of work for him. Past that point, I have only spoken the truth. I was and still am a continuing victim of Mark Towle and Kory Geick. If he has filed sworn statements and papers stating I did things without his knowledge in his case with DC Comics, then the records and recordings from my case have everything within them needed to convict him of perjury. The recordings alone verify in his own words with him speaking that he reviewed the Web Site approved it and considered it great.
So basically, he uses me for many years, gets me to do untold hours for years of work for him, never pays me, never gives me the Butts Batmobile Mounted Replica, costs me lots of money in a law suit he forces me to file against him then fraudulently sues me from California making tons of claims that are false that he tried to set me up for. I collected more than enough evidence to prove I didn't do what he has accused me of. He continues to deny me what I earned and paid for and now I hear through the grapevine he is "evidently and by report presented to me" slandering me to the Courts in his other Law Suit with DC Comics. WOW! This guy is so nice isn't he? UNBELIEVABLE!

DC Comics wins it's Law Suit stating that Mark Towle's advertising could be confused as that of DC Comics. Guess I was too good at Advertising. Not surprising since he demanded more and more and more of me, flash, animations, on and on.... Let's hope he loses this next one with me. Now he has a history. Should help in my case though I feel bad for all the other Independent Builders. I'm still coming Mark Towle! You owe me a Butts Batmobile Replica and Much Much More!

Case Update:
I appeared by Telephone today in the Superior Court of California representing myself for a status hearing in Mark Towle's frivolous and most heinous Civil suit against me. Mark Towle's attorney was a No-Show to the hearing. The hearing took place without any representation present on behalf of Mark Towle.
The Judge in this case continued the Stay of Action upon Mark Towle's claims against me for 90 days until the results of the Appeals to the Supreme Court of West Virginia is determined.
Mark Towle's attorney failed to appear for the hearing.
I am still seeking witnesses against Mark Towle. Please contact me if you can be of any assistance.

Apparently it's a legal tactic to take Jurisdiction and also to put me at further disadvantage by having to travel to California. He has no real claim against me. I have him recorded either telling me to do the things he has accused me of or emails proving I was told to do certain things. I started preparing my case long before we broke association. Mark Towle has also told the Riverside Court I owe him $22,500. He Claims I owe him a Batmobile Replica. I work for him for 5 years he doesn't pay me with my car, and then he says I owe him a Batmobile Replica Kit. It's pretty amazing.... You gotta just shake your head in amazement.
I filed my appeal on time for Jurisdiction with The West Virginia Supreme Court of Appeals.
I am still seeking witnesses against Mark Towle. Please contact me if you can be of any assistance.

I am still awaiting a decision from the West Virginia Supreme Court of Appeals concerning jurisdiction and I have filed an answer in California Riverside Court denying all of Mark Towles claims against me, as I can prove they are all false with recordings, emails and messages I was left.
Mark Towle's West Virginia Attorney, Glen Koontz was found guilty by the State of West Virginia Office of Disciplinary Councel of behavior in violating rules of procedure, specifically rule 8.4(c) of the rules of Professional conduct which provides that "[i]t is professional misconduct for a lawyer to engage in conduct involving dishonestly, fraud, deceit or misrepresentation." This Lawyers review board is filing their findings against Mark Towle's Attorney with the West Virginia Supreme Court of Appeals.
This conduct has been put in Mark Towle's Attorney's permanent record and will be available to the public. It is very important to note and I can say this publicly because it is true that the term "Lawyer Boy" that was used against me in this thread earlier is the same term that was included as part of the language used against me by Glen Koontz in his violations not becoming of an Attorney. He's been admonished by the Lawyer review board, yet his words against me were also posted here in this forum by a member named scottleeslayer. This creates pretty strong circumstantial evidence that the posts from this member were from Mark Towle, kory Geick, his Attorney or someone closely associated to Mark Towle.
I am finishing a counterclaim of unlimited damages against Mark Towle to be immediately filed against him in California Riverside Superior Court in the event that I lose my appeal for jurisdiction in West Virginia.
In the last case management hearing Mark Towle's own attorney indicated to the California judge that he anticipates that West Virginia Courts will retake jurisdiction and chose not to proceed at this time with Mark Towle's bogus case against me. The California case at this time remains stayed, but I filed an answer to keep from getting a default judgement.
I'm hopeful that I won't have to travel to California but am already making plans to do so and will continue to chase what I m owed and due 3000 miles from here if needed.
I also am planning to make my entire story public after all of this is finished to help the public to avoid what I am being put through..... To protect all of you. I may build a web site, I might write a book, but my story will be told. I have refused settlements that included that I must remain silent in the future. The settlement offers from Mark Towle were disgraceful to date. He wanted everything and demanded my silence and offered me only what he had admitted in contract I already owned. To date he has refused to stipulate in any settlement offer that the "Butts" Style Batmobile replica Kit I am owed and he earlier admitted I outright own would be offered or delivered to me. Basically he seems to want to deny me a Butts body either mounted or not on my Corvette. I have no idea where my property is or what has been done with it.

In regards to the DC Comics case against Mark Towle for Trademark infringement. I have not been charged with any wrong doing by DC Comics nor have I heard from them in some time. I contacted them and gave them the serial number of my car as well as paperwork proving that Mark Towle sent me what he considered proof of ownership of the Butts Batmobile Kit as well as the 89 Corvette it was assembled onto. Should they confiscate my car they have been legally notified that this is my property and not that of Mark Towle's and that this replica was constructed prior to any rulings in the DC Comics Mark Towle case. I have demanded my property be released to me if they manage somehow to obtain it.
They have not approached me to help them in their case in a long time. I think they figure they have Mark Towle right where they want him and don't need me to testify. I fully expect that the appeal Mark Towle filed with DC Comics will fail and if it does somehow succeed to bring the case back into court, then a trial against him will proceed. I expect by DC Comics' silence to me to represent that they already have it covered and that Mark Towle will not prevail. DC Comics as I stated to their attorneys do not need me to win their case, there are other people that came forward and provided the documentation they needed. More than they needed.

A Case Management hearing was held in California Superior Court today in which I appeared by Telephone on Sept 6 2013. Mark Towle's case against me has been continued stayed until December. The Court was made aware that I have filed an answer denying all of Mark Towle's claims as well as my notification to the Court that I have all the evidence needed to prove his claims false within my response that I can bring to Court. Mark Towle's Attorney, Mr. Bennett confirmed that he did receive my Answer as well as agreed to a further stay.
We are still awaiting The West Virginia Court of Appeals to make a Decision in Jurisdiction of this case. Today I am sending them even MORE evidence of Kory Geick's working for Mark Towle even though they both gave Sworn Declarations to the Circuit Court of Jefferson County that they do not have any association with each other professionally. We all here know how true those Declarations that Kory has never represented himself as working for Mark Towle are. Now don't we? They Both gave these Declarations to a legal Court within the United States.
I am still seeking anyone that could provide further testimony to me of their actual work relationship.

I see a new web site is up for someone though he himself told me it wouldn't take long to get a new site after what he did to me. Over 2 years????? Say WHAT? All I have to say is I hope the Designers got paid up front. This is Great! This will definitely help my case. I am sooooo Happy my art is off his Forum and good people won't be led astray any longer by my Design work. And the site he has now???? So Happy to See It! Karma is working Overtime!
