1989 Batmobile Copyright almost up!

Hey there guys. I was talking to a contact I have and he told me that the patent, or copyright or whatever for the Keaton car expires in November of this year! Of course, this was only one guy's word... Does anyone know how I can verify this? If its true, it opens a whole new world of possibilities! I, for one, am very excited about the possibility.

The way I understood it, they need a reason to renew it. I.e, they renewed it for Batman Returns. They no longer use the vehicle, in its full sized actual form, for profit. Therefore, as far as I can see, they cannot yet renew it. It is the same principle which caused the 60's car copyright to eventually expire. They stopped using the car, so the copyright eventually had to expire. But who knows? I am waiting to hear for sure, beyond any doubt.

well you gotta remeber if they want to renew it bad enough they do have a lophole, since they used it on the onstar comical im weilling to bet onstar had to pay them to use the car deisgn, there for the last tiem it was used was a few years bacc which they could prob use as a excuse to use it, or say they batmobile is a attraction at 6 flags witch they make a profit off of.

The patent # DES.311,882 was Applied on April 28,1989. The patent was approved on November 6, 1990 for a term of 14 years, it expires on November 6,2004. Patents CANNOT be renewed after the expiration date. The ONLY exception is when drug manufactures patent a new drug or process and is awaiting FDA approval; an extension can be applied for time lost during the approval period.
Now; WB can and will take anyone to court, if they feel that their franchise is being infringed upon. By the use or misuse of there copyright name of Batmobile, Batman and so on.
Copyrights have no expiration dates they last forever and can be transferred from individual or entity. Such as the bat emblem is copyright protected.

it just seams to me that they will probaly renew it before it expiration date, seeing as it is still a inuse design. dont get me wrong im hoping it runs out, makes it a bit safer for me and my batmobile.

I think what Kevin is saying is, that you cannot renew a patent PERIOD, before or after it expires. Is that correct, Kevin, or no?

a patent can be renewed, and in some case aftr its end date, but they have to apply within 19 months from the date the patent ended. its under the terms of section 28 of patents act 1977 and rule 41 of the patents rule 1995, but there is a catch, it might not be renwed after the endday if they dont provide convincing evidence that at the time of the renwal fee they intended to renew it and took resanable care to do so. bascily hey have to prove they efficently oprated and had a remider system. if the patent office choses not the renew it after its endinded they can choose to have a hearing but have to file for that within one month form the time they hear it was not being renwed. keep in mind if they pay the renewal fee anytime befor it ends its automaticly renwed.

Who has to do this? Warner Bros. or the family of Anton Furst? I thought he help all copyright and patent rights? Or am I way off base here?

it would be whoever owns the patent and i belive wanner brother does. it would expline why wanner brother has gone after people in a lawsuit and not anton furst. but im not sure. i have not seen the patant, you should be able to look it up on the us patent gov site, i know theres 2 batmobile items there i just was not able to view them because i dont have the right version of quicktime

I have posted the US Patent Office stipulation on patents. Only under certain conditions patents may be extended. Nowhere does it speak of patents being renewed. The Batmobile doesn't fall under any of these categories. The renewal you speak of is the fees paid to keep the patent in effect during the period.

The term of the patent shall be generally 20 years from the date on which the application for the patent was filed in the United States or, if the application contains a specific reference to an earlier filed application under 35 U.S.C. 120, 121 or 365(c), from the date of the earliest such application was filed, and subject to the payment of maintenance fees as provided by law. A maintenance fee is due 3 1/2, 7 1/2 and 11 1/2 years after the original grant for all patents issuing from the applications filed on and after December 12, 1980. The maintenance fee must be paid at the stipulated times to maintain the patent in force. After the patent has expired anyone may make, use, offer for sale, or sell or import the invention without permission of the patentee, provided that matter covered by other unexpired patents is not used. The terms may be extended for certain pharmaceuticals and for certain circumstances as provided by law. Under certain circumstances, patent term extensions or adjustments may be available.
