My Counter Complaint short name is Lee VS Towle and carries the same case Number.
My Counter Complaint carries nearly 70 (accused violations of agreement) and 20 causes of Action for Damages.

Today I attended a Case Management Hearing, Mark Towle nor his attorney bothered to attend by telephone or otherwise. My next Case Management hearing is slated to take place on September 10th 2014. I have filed several more documents, that I can reveal after they are successfully filed and entered into the public record. One which will be of great interest to anyone that is considering ever dealing with Mark Towle in business.

I would have to say I am wondering why Mark Towle has removed the Mach 5 from his new incomplete web site, his forum seems to have no action, the web site still sits with most of it uncompleted. Have to wonder if Mark has received something legal from Tatsunoko in Japan. The Mach 5 has mysteriously been pulled from his list of cars offered. Currently he is showing only a Paddy Wagon and The Munsters Koach and one has to wonder if he has licensing for either of those to build them as well. Speed Racer Enterprises in America according to web articles like the one below lost all of the rights, so you have to wonder how Mark Towle can or was able to continue building Mach 5s in America. Is this why suddenly his Mach 5 is no longer offered on his itsy bitsy Web Site? Mark Towle told me 3 years ago that he would have no problem getting another Web Site as good or as grand as he got from me while he was telling me I would be hearing from his Attorney, yet here we are 3 years later and his site is incomplete, showing only 2 replicars available and most sections claiming Opening Soon we are building something Great, Sit Tight! I mean what are these guys doing anything other than defending Law Suits? I betcha Mark Towle is wondering if he shouldn't have just paid me what I was owed.

In October 2012, anime studio Tatsunoko Production (Gatchaman, Tekkaman, Samurai Pizza Cats, Macross) filed suit against James Rocknowski, John Rocknowski and Michael Cisneros of Speed Racer Enterprises Inc. The filing in California Central District Court sought damages for nine causes of action, including false advertising, unfair competition, interference and misappropriation of intellectual property rights. Tatsunoko has announced announced that the suits have been settled by mutual agreement of all parties and are being dismissed in full.
Tatsunoko said that they granted Speed Racer Enterprises a 10-year license to Speed source material Mach Go Go Go in 2000, which was then extended a year in summer 2010. During that time, the Rocknowskis oversaw production of the Speed Racer: The Next Generation animated series, which aired on Nicktoon alongside the launch of the independently produced live-action Speed Racer movie.
Tatsunoko asserted that the the defendants continued to claim that they owned the Speed Racer rights after they expired in May 2011, and the defendants misappropriated and exploited the rights, licensing the property to a list of companies that includes Hollywood studio Lions Gate and Toonz Entertainment.
According to the settlement, the Speed Racer rights terminated in their entirety on May 31, 2011 and at that date, rights automatically reverted to Tatsunoko. As a result, Tatsunoko alone owns and controls the rights to Speed Racer intellectual property rights worldwide.

I have successfully filed my Amended Answer against Mark Towle.
I have successfully filed my Cross Complaint against Mark Towle.
I have successfully filed my Demand Letter to force Mark Towle to allow inspection of my Replica.
I have successfully filed my Motion to Prosecute Mark Towle for intentionally filing fraudulent Documents within the Superior Court of Riverside California and swearing them to be true.
I am seeking criminal convictions upon Mark Towle for violations of Penal Code 115PC filing false Documents and also Penal Code 470-483.5 for Forgery of a document.

Unfortunately after filing my Demand Letter for Mark Towle to allow inspection of my Batmobile replica and prove it's current condition his attorney told me he did not have the paperwork even though he admits to receiving other filings that were sent to him in the same packet. It seems I am going to have to request a Court Order to be placed on Mark Towle to force him to prove he has not disposed of sold or destroyed my replica. That will be my next step, requesting a Court Order from the California Superior Court forcing Mark Towle to disclose the location of my owned now for years, Batmobile Butts Kit and what he claims I own, the poor condition Corvette he claims he purchased in total violation of our contract for the build and sent me lien paperwork for. If Mark Towle does not have my property he is most likely bound for convictions on multiple Criminal theft felonies and Criminal Fraud to be charged upon him at some point in this suit.

Update on my Case I have successfully filed my Cross Complaint against Mark Towle. I have filed a motion to dismiss Mark Towle's case against me because he filed a fraudulent contract from our first agreement and a forged altered contract from our second agreement. I have also filed a Motion for Contempt against Mark Towle and his Attorney. At Present Mark Towle is listed as unrepresented in my counter claim against him. I will need to find out if Mark Towle has been unable to get his Attorney or any other to accept representation of the Cross Complaint I have active against him or if there is some other reason he is listed as not having an Attorney to Defend himself. Below is the latest screen capture from the Superior Court of California. Is the Fact that Mark Towle is listed as Unrepresented and yet not listed as Pro-Per a good indication that Mark Towle does not have the resources to get an Attorney to represent him in my Counter Claim? Is this also representative of a reality that Mr. Bennett will not take another case on Behalf of Mark Towle? Also, I believe I now have the proof I need to have his Attorney admonished by the Judicial Review Board just as I was able to do to his West Virginia Attorney. I'm whipping out my Big Hammers and still pounding hard for my my Property, Stay Tuned, Same Bat Time and Bat Channel.

Unfortunately my Motion was denied I need to Contact the District Attorney in California and refile my motion for Contempt with the Court. Mark's Attorney claimed that due to my motion he expended over $5,000 dollars in legal fees defending my motion. He attempted to try and get me Court ordered to pay Mark's Attorney Fees but the Judge didn't allow that. I still don't understand why Mark Towle wants to spend all of this money instead of just giving me my Batmobile Replica. Mark is likely into this thing way deeper financially than I could have ever suspected if Mr. Bennett's fees to defend a Motion exceeds 5K. I wonder if Mr. Bennett will get paid? 3 years later I am still trying to get paid. Mr. Bennett told the Judge I was out of Control. I'm just doing what I can to try and get my Replica. As a Pro Se Litigant I can only do the best I can, Mr. Bennett was upset about my 100 page Counterclaim. It takes a lot of pages to explain 5 years worth of Breaches of agreement. Mark should have just given me what I earned and paid for. I will fight on.

It apears that Mark Towle's Attorney has left the cases. I noticed today that Mark Towle is now listed as Pro-Per meaning that Mark Towle is now acting as his own Attorney. One can only speculate why. Here is the most recent Court Docket Screen shot.

The hearing of Oct 15 took Place, my motion for Dismiss and Complaints were denied "at this time"
My motion for inspection of my property was granted. I am trying to arrange an inspection of my property at this time in California.
Mark Towle all along claimed he delivered the Batmobile Kit to me in California at his shop and it is my property.
Mark Towle recanted his position and claimed he never delivered the Batmobile Kit to me in Califoirnia at his shop within this hearing, and that it could NEVER be delivered due to his injunction from DC Comics.
He then flip flopped again immediately filed paperwork claiming he did deliver the Batmobile Kit to me at his shop in California. I have not been to California and was never allowed to pick up my Batmobile Kit though I did try to arrange for it to be pickled up and pleaded for it to be released to me before being coerced into a second contract.
Mark Towle also stated to the Judge that he is the only person in the World that knows how to stretch a Corvette Chassis properly so therefore during my inspection no photos can be taken of the undercarriage.
Mark Towle is the only person in the World that can stretch a Corvette correctly? Seriously?
Mark Towle told the Judge that he is no longer represented by an Attorney because he can no longer afford one.
So now I am waiting on a Court Order to force Mark Towle to allow an open inspection of my replica, he claims he still has it but has allowed it to deteriorate and doesn't want to be made responsible for it's maintenance or to get it running or drivable or any degradation that has occurred since his forcing these Litigations.
Mark Towle is claiming he has insufficient knowledge of Kory Geick to answer my Complaint so therefore
I am currently researching and preparing to add Kory Geick to my Cross Complaint as a Cross Defendant. If Mark Towle wants to deny his business relationship with Kory Geick then Kory Geick can be held responsible as well for all of my losses.
So there is your update!
