Building is fine..selling it and calling it official batmobile is a no no.....

Well if that is the case, then DC and WB may have succeeded in making the car even more exclusive and therefore more desirable. I have no doubt that we will still see more cars replicated in the future

Remember, kits were available a long time ago when the patient was still considered 'active' and the threat of legal action a real concern. Back then builders and the community were nervous and worried about the 'cease and desist' possibility or the even worse 'what if's?'

Only time will tell whether we have seen the last kit or not

Where is the ruling on Mark Towle's appeal? We all expected it by now and yet all remains silent. A friend said he can't even find it on the Docket. Is it already decided and we don't even know about it? If anyone has any info please post it here.

I contacted the 9th Circuit Court today to check on the progress of this case. I was told that it is still in process, that there is no postponement and that oral arguments have not been set for a date though they have been asked for. I asked for a date when the Clerk thought this case would be ruled upon and she declined to answer stating only that it is waiting for the Judges to get to it. According to the Attorney's for DC Comics, anyone that replicates any Trademarked items are in Trademark Violation. Will they come after a single project? Their history states no, but that doesn't mean they don't view the lone Builder building something for himself at home to be not in Trademark Infringement. So technically no you can't. The ruling expected from the 9th Circuit Court and in the Mark Towle case will be defining as to this I think and should be released as final or continuing at the District Court Level by January or February 2015. I think.

In my case during the hearing of October 15 2014. Mark Towle informed Judge John Malloy that he could no longer afford an attorney to battle me in my case against him. Would this mean that he can no longer afford an Attorney to fight DC Comics if his appeal is supported and he is returned to District Court? We will wait and see.

Just my two cents about the toy companies being in control. I used to know a couple of the higher up's at Kenner. The Batmobile from returns was changed for Batman forever, because of an entirely different production crew and actors. They wanted to get as far away from the Burton-Keaton films as they could, because it was a new director's vision.

Toy companies HAVE had a long relationship with cinema though, and I can verify that nearly all the character names (aside from main characters) in the Star Wars universe came from Kenner, and Mattel has a really BIG say, in how NASCAR stockers look these days, even though you'll never see that red Mattel dot on any of the real cars.
